How long does it take to receive a Single Status Certificate?

The applicant of the Certificate shall submit the declaration in standard form. In case the applicant wants a certificate for the purpose of marriage, he/she must meet all the marriage requirements as prescribed by the Law on Marriage & Family.
In the section “Giấy này được cấp để ” of the declaration; write the full name; date of birth; ID/passport number of the person who plans to get marriage; and the location where that person will register the marriage.
In case the applicant has a dead or divorced spouse, he/she must present the spouse’s Death Certificate or the Court’s divorce judgment/decision.
Under the current regulations, the Commune People’s Committee requires the following papers to confirm marital status:

1. “An applicant for certificate of marital status shall submit an application form using the form as prescribed. In case the application for certificate of marital status is submitted for marriage purpose; the applicant shall satisfy all conditions for marriage as prescribed in the Law on marriage and family.
2. If the applicant for certificate of marital status had been married but he/she obtained divorce then or his/her spouse died; he/she must present or submit valid documents proving such status; in case of the circumstance prescribed in Clause 2 Article 37 of this Decree; additionally, a respective copy of vital records.
3. Within 3 working days from the date on which the satisfactory application is received; the civil status official shall verify the applicant’s marital status. In case the applicant meets all conditions and the issuance of certificate of marital status is consistent with regulations of law; the civil status official shall request the President of People’s Committee to issue one certificate of marital status to the applicant. Also, contents of certificate of marital status shall be consistent with the applicant’s current marital status and purpose of the certificate of marital status.

So, within 3 working days from the date of receiving the satisfactory application, the civil status official shall verify the applicant’s marital status. the civil status official shall request that the President of the People’s Committee to grant a certificate of marital status to the applicant, if the applicant meets all conditions and the issuance of the certificate of marital status is in accordance with the law.

How long is the Single Status Certificate valid?

According to Article 23 of Decree 123/2015/ND-CP; The single certificate will be valid for 6 months; from the date the competent authority issued it, due to the procedures prescribed by law.

1. Marriage registration declarations of both spouses in standard form;
2. Document proving the marital status of the foreigner issued within 6 months before the date of dossier receipt by a competent agency of the country of citizenship of that person, which certifies that this person is currently unmarried. 5. Permanent or temporary residence card or temporary residence certificate for foreigners permanently or temporarily residing in Vietnam.
6. A non-resident foreigner in Vietnam shall submit a written certification that he/she is eligible to get married issued by a competent agency of the country of his/her citizenship, unless the law of that country does not prescribe the grant of such certification.

When would a request for a single status certificate in Vietnam to register a marriage with a foreigner at foreign competent authorities be denied?

1. The Vietnamese citizen requests granting single status certificate in Vietnam to register their marriage with foreigner at a foreign diplomatic mission or consular representative mission in Vietnam;
2. The examination and verification result shows that the marital status of the Vietnamese citizen is inconsistent with the declaration in the dossier; the partners are ineligible to get married under the Law on Marriage and Family of Vietnam;
3. The interview result shows that the partners have not understood the family and personal circumstances of each other or the language, customs, practices, culture and law on marriage and family of each country; or
4. The marriage is arranged through brokerage for profit-seeking purpose; is sham not for the purpose of building a well off, equal, progressive, happy and sustainable family; or is made use of for human trafficking, labor exploitation, sexual abuse or for other self-seeking purposes.
