According to Clause 3, Article 3 of Circular 85/2019/TT-BTC; the price for civil status is a fee that falls under the competence of the provincial People’s Committee.

On the other hand, Point c, Clause 2, Article 5 of Circular 85/2019/TT-BTC stipulates the base for determining fee and charge rates as follows:

Based on socio-economic conditions in the locality where the service arises, the Provincial People’s Committee shall stipulate appropriate fees and charges.

Procedures for issuing certificates of marital status

According to Article 22 of Decree 123/2015/ND-CP, the issuance of a certificate of marital status follows the following procedure:

  1. Prepare the application
  2. Submit the application to the competent authority
  3. The authority receives, processes, and issues the certificate.

Within 3 working days from the date of receiving the satisfactory application, the civil status official shall verify the applicant’s marital status.

Then, the civil status official shall request that the President of the People’s Committee grant a certificate of marital status to the applicant if the applicant meets all conditions.

In case it is necessary to prove the marital status or to have a re-examination, within 03 working days from the date of receipt of the written request, the commune-level People’s Committee is requested to verify and send a written reply to the People’s Committee of the commune. Commune-level People’s Committees on the marital status of the involved parties during their residence in the commune.

If a person applies for re-issuance of a certificate of marital status for other purposes or due to expiration of the certificate of marital status as prescribed in Article 23 of this Decree, the certificate of marital status that was issued must be returned.

Can an authorized person apply for marital status certificate?

According to Article 2 of Circular 04/2020/TT-BTP, only for the case of marriage registration, re-registration of marriage, registration of recognition of father, mother, and children; the law allows subject to authorize another person.

Provision on the validity of marital status certificate?

Article 23 of decree 123/2015/ND-CP
1. A certificate of marital status shall remain valid in 6 months from the date of issue.
2. The certificate of marital status shall be used for the purpose of marriage at a competent authority in Vietnam, or at a competent authority overseas or for other purposes.
3. The certificate of marital status shall be invalid if being used for a purpose other than those specified in the certificate.

What are the conditions for birth, marriage or death re-registration?

1. Any birth, marriage, or death registration that has been granted at the competent authority of Vietnam before January 1, 2016 but the vital records or originals copies from vital records are lost shall be eligible for re-registration.
2. An applicant for birth, marriage, or death re-registration shall submit sufficient copies of relevant documents.
3. The birth or marriage re-registration is only granted if the applicants are still alive at the time of receiving application.
