What is a journalist card?

According to the provisions of the Press Law, and a journalist’s card is a card which people use who work in the press and television broadcasters. To be able to operate in the fields of journalism, you must have a Journalist card issued by competent authorities.

New regulations on granting press cards

According to the bill, the Ministry of Information and Communications considers issuing press cards in two phases. The time of considering and granting press cards is January 1 and June 21.

The term for granting a journalist’s card is 5 years. The Ministry of Information and Communications will consider issuing. And renewing a journalist’s card with a new term on January 1 of the year. The validity of the current journalist’s card is from January 1, 2021.

Subjects of application for grant, exchange, change, and re-grant of press cards include. Issuing press cards to persons who fully meet the conditions and criteria specified in Article 27 of the Press Law for press activities. So, issue and exchange journalistic cards to those granted press cards upon the expiry of the journalist’s card’s term. If a person who has been granted a journalist’s card is transferred to work at another agency or unit. But is still subject to the grant of a journalist’s card according to the provisions of Article 26 of the Press Law. He/she must carry out procedures to change the journalist’s card back to the state. The person who lost or damaged it wants to re-issue with a press card.

Electronicize the application file for a journalist’s card

A new feature of the draft Circular is that the application for a journalist’s card includes documents and papers in electronic form:

a) A declaration of registration for the grant of a journalist’s card, made according to a form. Moreover, authorities must sign and stamp or digitally signed by the head of the agency (Form No. 01);

b) Originals or copies of documents and papers: University or college degrees (for the case specified at Point b, Clause 1, Article 27 of the Law on Press), certified by a competent authority for copies of documents and papers;

c) Originals or copies of documents and papers. Recruitment decision, labor contract and other relevant documents to prove the continuous working time of 2 years or more. The press requesting the issuance of the card or at the district-level radio and television station and the equivalent. Therefore, it must be certified by the press agency for copies of documents and papers;

d) List of published and distributed journalistic works, for the cases in Clauses 5 and 6, Article 26 of the Press Law;

The Ministry of Information and Communications only considers granting, and changing press cards for valid dossiers of applications.

Revoke journalist card

For the cases in which the journalist’s card revoke as prescribed in Clause 6, Article 28 of the Press Law. Besides, the Minister of Information and Communications shall issue a decision on the revocation of the journalist’s card.

Within 15 days from the date of issuance of the decision to revoke the journalist’s card. The head of the agency of the person whose press card shall have to collect the journalist’s card and submit it to the Ministry of Industry.

Any case of being stripped of journalist’s card?

The procedure-conducting agency decides to prosecute the accused. 
In case the competent authority suspends the investigation or the case against that journalist or from the effective date of the court’s judgment or decision declaring that journalist is not guilty or exempt from liability. Moreover, in criminal cases, the state management agency in charge of the press shall return the press card;
Being disciplined by a competent authority in the form of warning or more. Being reprimanded twice in 2 consecutive years in accordance with the law on civil servants and public employees and the law on labor;
So, quit but do not return the journalist card.

Who has authority to strip press card?

According to the provisions of Circular 49/2016/TT-BTTTT detailing and guiding the application, procedures for granting, changing, re-granting and withdrawing the press card. The press card shall be revoked in cases where the press card is revoked. Next, specified in Clause 6, Article 28 of the Press Law, the Minister of Information and Communications shall issue a decision to revoke press cards.
