What is a land database in Vietnam?

According to the provisions of Clause 23, Article 3 of the Land Law 2013:

A land database is a collection of arranged and organized land data for access, exploitation, management and updating through electronic means.

According to Circular 34/2014/TT-BTNMT, land data is defined as follows:

Land data is land information in digital form presented in the form of symbols, letters, numbers, images, sounds or the like.

A land database is a collection of arranged and organized land data for access, exploitation, management and updating through electronic means.

Thus, a land database is a structured information collection of cadastral data, land use planning data, land price data, statistical data, organized land inventory, and organization to access, exploit, manage and update regularly by electronic means. How is the construction of the national land database regulated?

According to the provisions of Article 3 of Circular 05/2017/TT-BTNMT stipulating the construction of the national land database, including:

• Land database built by central agencies

• The land database is organized by provinces and centrally run cities.

Regulations on land databases developed by central agencies

The central agency shall organize the construction of a land database, including:

• Statistical database, land inventory: data reports, tables, statistical tables, land inventories, maps of current land use at regional and national levels; data on thematic land use management;

• Database of land use planning and plans: data of reports and summaries, maps of the current state of land use, planning maps, land use plans and adjustment maps of plannings and plans. land use planning at national level, socio-economic region;

• Land price database: data of land price bracket, land price in the bordering areas between provinces and centrally run cities (hereinafter referred to as bordering areas).

Regulations on land databases built by provinces and centrally run cities

Provinces and cities directly under the Central Government organize the construction of a land database, including:

• Cadastral database: data on making and correcting cadastral maps, land registration, issuance of certificates of land use rights, ownership of houses and other land-attached assets (hereinafter below) called Certificate), cadastral records;

• Statistical database, land inventory: data reports, tables, statistical tables, land inventories, maps of current land use at commune, district, and provincial levels; thematic data on land use management is made according to the decision of the competent authority;

• Database of land use planning and plans: data of reports and summaries, maps of the current state of land use, planning maps, land use plans, adjustment maps, and plans. land use planning of the province and district level;

• Land price database: land price table data, adjusted and supplemented land price list; land price adjustment coefficient; specific land prices; winning price at auction of land use rights; land price information in the land parcel information collection sheet.

Principles of building and updating the national land database

The building and updating of the national land database is carried out according to the principles specified in Article 5 of Circular 05/2017/TT-BTNMT of the Ministry of Natural Resources and Environment as follows:

• The construction and updating of the national land database must ensure completeness, accuracy, science and timeliness.

• The content, structure and type of information of the national land database shall comply with the technical regulations on land database of the Minister of Natural Resources and Environment.

• Component databases of the national land database must be built at the same time and linked and integrated with each other; if conditions are not met, priority shall be given to building a cadastral database as a basis for building and spatially positioning other component databases of the national land database.

• The size of the organization implementing the construction of the cadastral database is determined by district-level administrative units.
