In recent years, the demand for investment, international business, or moving abroad has increased. The papers, records, documents, although valid in one country, may not have legal validity in another country. Therefore, legalizing documents, creating favorable conditions for individuals, organizations and countries will develop a process called “consular legalization. So, in Vietnam, how is the consular legalization procedure regulated?

What is consular legalization?

Clause 2, Article 2 of Decree 111/2011/ND-CP stipulates:

“Consular legalization” means the certification of seals, signatures, and titles by a competent Vietnamese agency on foreign papers and documents so that such papers and documents can be recognized and used in Vietnam.

Dossier for consular legalization

Consists of:

Declaration of consular certification/legalization, made according to form No. LS/HPH-2012/TK (Can print from the Consular Work Portal – Ministry of Foreign Affairs:  rinhsuvietnam.gov.vn): 01 original

Then, papers and documents requested for consular certification. Photocopies of papers and documents requested for consular certification: 1 copy.

Translation of papers and documents that requested for consular legalization into Vietnamese or English (if such papers and documents don’t in these languages). The translation is not certified. The applicant is responsible for the accuracy of the translation: 1 copy

Not last, copy of the translation of papers and documents: 1 copy

And last, an envelope describes the recipient’s address (You send the application by post and return the results by post): 1 copy.

Consular legalization procedures

Step 1. Prepare documents

When preparing documents, there are a few things to keep in mind:

Papers and documents exempt from consular legalization:

Papers and documents that exempted from consular certification and legalization under international treaties to which Vietnam and related foreign countries are members; or on the principle of reciprocity.

Secondly, documents and papers which transferred directly or through diplomatic channels between a competent Vietnamese agency and a foreign competent authority.

Papers and documents are exempt from consular certification and legalization by Vietnamese law.

Papers and documents that are not required by the receiving agency of Vietnam or abroad for consular legalization or certification by the respective laws of Vietnam or.

Elligal paper that not consular legalized:

Above all, papers and documents that fixed or erased but not corrected according to the provisions of law.

Papers and documents in the application file for consular certification and legalization contain conflicting details.

Then, papers and documents that forged or issued or certified against authority as prescribed by law.

Last, papers and documents with contents that infringe upon the interests of the State of Vietnam.

Step 2. Submit application

The applicant can choose the location that is most convenient for him or her, according to which:

Step 3. Waiting for the application to be processed

The time limit for settlement is 01 working day from the date of receipt of complete and valid dossiers. In case the application has 10 or more papers and documents, the processing time may be longer but must not exceed 05 working days. The time limit for settlement of this time limit can calculate based on the number of papers and documents requested for consular legalization; regardless of the document, the document has one or more pages.

Step 4. Get Result

Finally, within 05 working days from the date of receipt of the request, the agency or organization shall have to reply in writing to the Ministry of Foreign Affairs. Immediately after receiving the reply, the Ministry of Foreign Affairs shall settle and notify the result of the requester.

So, receive results directly at the office of the agency according to the application receipt, or the dossier is returned by post to the litigant.
