Circular 01/2011/TT-BNG stipulating procedures for granting an entry permit for corpses, remains, and ashes to Vietnam.

According to article 6, Licensing procedures:

1. The applicant for a license shall submit 1 set of documents, including:

Firstly, 01 application for bringing the corpses, remains, and ashes home, made according to form No. 01/NG-LS issued together with this Circular;

In addition, papers proving that the applicant falls under the category specified in Article 5 of this Circular:

– 01 copy of passport or valid entry and exit papers of the applicant;

– 01 photocopy of papers proving the relative relationship with the deceased also;

Furthermore, 01 copy of the household registration book of the applicant in case the deceased falls under the category specified at Point b; Clause 1, Article 3 of this Circular;

Additionally, 01 original of power of attorney in case the applicant falls into the category specified in Clause 2; Article 5 of this Circular;

And 01 original of the written request in case the requester is the managing agency or unit of the deceased mentioned in Clause 3; Article 5 of this Circular;

Besides, papers proving that the dead person falls into the category specified in Article 3 of this Circular:

– Original passport or valid entry and exit papers of the deceased (if any);

Dossier of application for an entry permit for corpses and ashes to Vietnam

Firstly, 01 photocopy of the permanent residence permit in Vietnam of the deceased in case the deceased falls into the category specified at Point c; Clause 1, Article 3 of this Circular;

Secondly, 01 copy of the death certificate issued by a competent authority of the foreigner or a representative agency;

Thirdly, 01 copy of the certificate of health hygiene and quarantine issued by a competent foreign agency (for corpses); excavation certificates and certificates of hygiene and medical quarantine issued by competent foreign agencies (for remains); certificate of cremation of the body (for ashes);

Additionally, 01 copy of the application form for permission to bring the body remains. Ashes of a relative for burial and preservation in the locality, made according to form No. 02/NG-LS, certified by the People’s Committee of the commune, ward; the township of Vietnam; or the cemetery management agency if the deceased falls into the category specified at Point b; Clause 1, Article 3 of this Circular.

As can be seen; a dossier of application for a license can be submitted directly at the representative mission or sent by post. 

The settlement of the representative agency on the importation of corpses and ashes to Vietnam

For the case mentioned in Clause 1, Article 3 of the Circular:

After examining the dossier and finding that all the conditions specified in this Circular are satisfied; the representative mission shall carry out the following tasks:

Firstly, issue the License according to form No. 03/NG-LS issued together with this Circular; stamp the cancellation on the Vietnamese passport of the deceased (if any) and return the results to the license applicant within 1 working day. From the date of receipt of complete and valid dossiers.

Secondly, notify the grant of permits to the Consular Department of the Ministry of Foreign Affairs; the border gate Customs, the immigration management agency at the border gate where the corpses; remains, and ashes are imported.

Thirdly, a notice of cancellation of the passport validity of the deceased as a Vietnamese citizen to the Immigration Department of the Ministry of Public Security.

Lastly, record in the entry permit book of corpses remains and ashes according to form No. 04/NG-LS issued together with this Circular.

For the case mentioned in Clause 2, Article 3 of Circular

The representative mission shall send a telegram specifying the personal details of the deceased to the Consular Department of the Ministry of Foreign Affairs within one working day from the date of receipt of a complete dossier.

Besides, the Consular Department of the Ministry of Foreign Affairs shall send official correspondence to the relevant agencies within one working day from the date of receipt of the telegram from the representative mission and reply to the representative mission within one working day from the date of receipt of feedback from relevant agencies.

Additionally, within 01 working days from the date of receipt of the consent notice from the Consular Department of the Ministry of Foreign Affairs, the representative mission shall issue the License and reply to the applicant with the results.
