1. Activites of producing and trading prohibited goods

Article 10 of Decree 185/2013 ND-CP stipulating penalties for administrative violations in commercial activities, production and trading of counterfeit and banned goods and protection of consumers’ interests:

– For activites of trading prohibited goods specified in Clause 6, Article 3 of this Decree, the fine levels are as follows:

a) A warning or a fine of between VND 500,000 and 1,000,000 shall be imposed in case the prohibited goods are valued at under VND 1,000,000;

b) A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed in case the prohibited goods are valued at between VND 1,000,000 and under VND 3,000,000;

đ) A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed in case the prohibited goods are valued from VND 10,000,000 to under VND 20,000,000;

e) A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed in case the prohibted goods are valued from VND 20,000,000 to under VND 30,000,000;

g) A fine ranging from VND 30,000,000 to VND 50,000,000 shall be imposed in case the prohibited goods are valued between VND 30,000,000 and under 50,000,000;

h) A fine ranging from VND 50,000,000 to VND 70,000,000 shall be imposed in case the prohibited goods are valued between VND 50,000,000 and under 70,000,000;

i) A fine ranging from VND 70,000,000 to VND 100,000,000 shall be imposed if the prohibited goods are valued from VND 70,000,000 to under VND 100,000,000;

k) A fine of VND 100,000,000 shall be imposed in case the prohibited goods are valued at VND 100,000,000 or more without being examined for penal liability.

2. A fine twice the fine level specified in Clause 1 of this Article shall be imposed for the act of producing prohibited goods.

+ A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for illegally exchanging military insignia, conifer branches, soldier’s nameplate, military service emblem, kepi hat, field cap, regular military uniforms, field uniforms, service uniforms and other types of military equipment.

+ A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for illegally trading in military badges, insignia, conifer branches, soldier nameplates, military service emblems, kepi hats, field caps, commonly used military uniforms, field uniforms, service uniforms and other types of military equipment.
