What is the difference between the old and new red book and pink book?

Depending on the color, people often have different names for certificates of land use rights and ownership of assets attached to land, specifically:

  • The old pink book is the certificate of home ownership and residential land use right; issued by the Ministry of Construction.
  • The old red book is the certificate of land use right issued by the Ministry of Natural Resources and Environment
  • The new pink book is a certificate of land use rights, ownership of houses and other land-attached assets issued by the Ministry of Natural Resources and Environment (from December 10, 2009 to present)

Is it mandatory to change from the old red book or pink book to the new one?

Accordingly Clause 2, Article 97 of the Land Law 2013 :

“ The certificate of land use right, the certificate of house ownership and residential land use right; issue the certificate of house ownership, the certificate of ownership of construction works accordingly the provisions of this Law. The law on land, the law on housing, the law on construction before December 10, 2009 are still valid and do not have chang to the Certificate of land use rights, ownership of houses and assets. other property attached to land; If a person who has been granted a Certificate before December 10, 2009 wishes to renew it, he/she may change it to a Certificate of land use rights and ownership of houses and other land-attached assets in accordance with the provisions of this Law.”

Besides, point a, Clause 1, Article 76 of Decree 43/2014/ND-CP stipulates:

“Article 76. Issuance and renewal of certificates, certificates of houseownership and certificates of construction work ownership

1. The granting and replacement of the issued Certificate, Certificate of House Ownership, Certificate of Ownership of Construction Works; shall be carried out in the following cases:

a) The land user wishes to change the certificate of house ownership, the certificate of ownership of construction works or other types of certificates issued before December 10, 2009 to the certificate of land ownership right; land use, ownership of houses and other land-attached assets; ”

Thus, changing the old pink book and red book to the new pink book is not mandatory. The conversion will be done upon request.
