Cases in which foreigners must have re-issuance work permits in Vietnam

Firstly, the valid work permit is lost, damaged, or the contents stated in the work permit are changed; except for the cases specified in Clause 8 Article 10 of Decree 11/2016 ND-CP.

Besides, the work permit is valid for at least 5 days but not more than 45 days. 

Conditions for re-issuance of a work permit for foreigners in Vietnam

Just like when foreigners want to get a work permit, re-issuance of a work permit also requires the following conditions:

Firstly, the work permit is valid for at least 5 days but not more than 45 days.

Secondly, the job position and title of the foreign worker remain the same as the information on the issued and valid work permit.

Thirdly, have written approval of the position issued by the Department of Labor, War Invalids, and Social Affairs.

Fourthly, Within 15 (fifteen) days from receiving the written approval of the position issued by the Department of Labor; War Invalids, and Social Affairs, you must apply for an extension of work permit.

Finally, have health suitable for work requirements.

Step 1: Prepare documents for re-issuance of work permits for foreigners in Vietnam

Step 2: Submit documents for re-issuance of work permits for foreigners in Vietnam 

Individuals apply directly or send by post to the Department of Labor, War Invalids and Social Affairs.

The Department that receives and returns the results of processing dossiers; the City Department of Labor – Invalids and Social Affairs receives the dossiers; checks the validity and completeness of the documents contained in the dossiers.

If the application is complete and valid: the specialist receives, prepares, and delivers the receipt to the applicant;

If the dossier is incomplete or invalid: the specialist returns the dossier together with the request for additional dossiers to the applicant.

Step 3: Get the result for re-issuance of work permits for foreigners in Vietnam 

The City Department of Labor – Invalids and Social Affairs processes and issues work permits for foreign workers; within 03 working days from the date of receipt of a complete and valid application from the employer. In case of refusal to issue a work permit, a written reply is clearly stating the reason.

The employer of foreign workers will base re-issue the appointment date on the receipt to the Department to receive; and return the results of processing the application to the City Department of Labor – Invalids and Social Affairs to receive the results. 

Term of a re-issued work permit:

The term of a re-issued work permit as prescribed in Clause 1; Article 13 of this Decree is equal to the period of the issued work permit minus the employee’s time. Foreigners have been working up to the time of applying for the re-issuance of work permits.

The term of a work permit re-issued under Clause 2; Article 13 of this Decree is the same as one of the cases specified in Article 11 of this Decree but must not exceed 2 years.

In addition, if the work permit holder violates the law, the state agency will make the revocation of the work permit.
