In case an employee loses or damages his/her work permit, he/she must apply for a work permit again. A dossier of application for a work permit re-issuance includes: 

The employer’s written request for re-issuance of a work permit due to loss or damage in Vietnam under the Ministry of Labor; War Invalids, and Social Affairs regulations.

02 color photos (size 4cm x 6cm, white background, straight face; bare head, no colored glasses), photos taken within 06 months from the date of application.

The issued work permit

Firstly, in case the work permit lost; it must be certified by the commune-level police office of Vietnam or a competent foreign agency as prescribed by law;

Notably: The above papers are 01 photocopy; enclosed with the original for comparison or 01 certified copy. If foreign, consular legalization is exempt but must be translated into Vietnamese; and authenticate under the law of Vietnam. 

Procedures for re-issuance of a work permit due to loss or damage in Vietnam

Step 1: After the employee discovers that the work permit in loss or damage; or the information on the work permit has been changed such as full name; date of birth, nationality, passport number, date of issue passport; working location, workplace, the foreign national employee is responsible for reporting to the employer.

Step 2: The employer receives a report from the foreign worker informing that the work permit in loss or damage; or the information on the work permit has been changed such as full name; date of birth, nationality, passport number, date of issue of passport, workplace, place of work; the employer must submit a dossier to the provincial labor management agency; the place that issued the work permit to re-issue the work permit to the foreign worker.

Step 3: Submit your application

The place to receive and return the results One-stop-shop – Department of Labor – Invalids and Social Affairs.

In addition, the time limit for settlement: 03-05 working days, in case the work permit is not reissued, a written reply clearly stating the reason.

Besides, about fees: The fee for granting/re-granting work permits to foreigners working in Vietnam is a fee that falls under the jurisdiction of the People’s Council of the province/city to implement.
