Clause 1, Article 2 of Decree 111/2011/ND-CP stipulates the legalization of papers and documents as follows:
Consular certification means the competent Vietnamese agencies’ certification of stamps, signatures, and titles on Vietnam’s papers and documents for being recognized and used abroad.
Consular legalization is usually carried out when a citizen of a country wants a public document issued by the authorities of that country to be valid in another country, or vice versa, a document issued by the authorities of another country. In these cases, the document needs recognization by the authorities of the country where it has or wants to have legal effect.
Thus, the consular legalization means the competent authorities in Vietnam recognize the legitimacy of the papers and documents abroad and allow the papers and documents to used legally on the territory of Vietnam. Documents and papers that need consular legalization are usually seals, signatures, titles… on papers and documents.

Article 1. Agencies competent to carry out consular certification and legalization

1. The Consular Department and the Service of Foreign Affairs of Ho Chi Minh City of the Ministry of Foreign Affairs are competent to carry out consular certification and legalization in Vietnam.
2. After considering the needs, the personnel and facilities of each locality, the Minister of Foreign Affairs shall authorize foreign affairs Services/Divisions/Units of centrally-affiliated cities and provinces (hereinafter referred to as local foreign affairs agencies) to receive application for consular certification or legalization and return the results. The list of these agencies shall be regularly announced and updated on the Consular website: http://lanhsuvietnam.gov.vn.
Authorized local foreign affairs agencies must not reauthorize other agencies.
Officers of the authorized local foreign affairs agencies may only receive and handle applications for consular certification and legalization after being provided with professional training by the Ministry of Foreign Affairs.

Consular legalization dossier

A requester for consular legalization shall submit a dossier comprising: 

  • Firstly, a declaration for consular legalization, made according to a set form; 
  • Secondly, a personal identification paper, for production in case of direct submission; 
  • Thirdly, a copy of the personal identification paper, in case of submission by post; 
  • Fourthly, papers and documents requested for consular legalization, which have been certified by a foreign diplomatic representative mission or consulate or another foreign agency authorized to perform the consular function; 
  • Also, a Vietnamese or English translation of each paper or document requested for consular legalization, if such papers and documents are not made in these languages; 
  • Lastly, copies of papers and documents mentioned in the above two lines, one copy each for filing at the Ministry of Foreign Affairs. 

Consular legalization procedures

Step 1: Submit an application for consular legalization.
After receiving the application, if the application valid, the competent authority will consider and settle it. In case the dossier is not completed or has errors, additional requests shall be made as prescribed. Dossiers with 10 or more papers and documents may take longer but must not exceed 05 working days.

Step 2: Application process
The Ministry of Foreign Affairs shall carry out consular legalization on the basis of comparing stamps, signatures, and titles in certifications of competent foreign agencies on papers and documents with their specimens officially notified by the country concerned to the Ministry of Foreign Affairs.
When necessary to check the authenticity of papers and documents requested for consular legalization, dossier-receiving officers may ask requesters for consular legalization to additionally produce the originals of related papers and documents, and submit copies of these papers and documents, one copy each for filing at the Ministry of Foreign Affairs.
Step 3: Receive the results directly at the office or by post.
Results will be returned directly to the headquarters of the representative mission or sent back by post if requested by the involved parties.

Documents not subject to consular legalization

  • Firstly, papers and documents exempted from consular certification and legalization under treaties to which Vietnam and foreign countries concerned are contracting parties, or on the reciprocity principle. 
  • Secondly, papers and documents delivered directly or via the diplomatic channel between competent Vietnamese and foreign agencies. 
  • Thirdly, papers and documents exempted from consular certification and legalization under Vietnamese laws. 
  • Fourthly, papers and documents not required for consular certification and legalization by receiving Vietnamese or foreign agencies under relevant Vietnamese or foreign laws. 

Exemption from consular legalization

Exemption from consular legalization means that a specific type of document exempted from the consular certification of the competent diplomatic agency of the country for use. Documents that are only exempt from consular legalization will still have to be certified by consular regulations.
Thus, the owner can bring that document exempted from consular legalization from the issuing country to another country for use without having to carry out any procedures related to consular certification and consular legalization.

Papers exempted from consular legalization

According to the provisions of Article 9 of Decree No. 111/2011/ND-CP dated December 5, 2011, of the Government, 4 types of papers as well as documents exempted from consular certification and legalization:

  • Firstly, papers and documents are exempted from consular certification and legalization under treaties to which Vietnam and foreign countries concerned are contracting parties, or on the reciprocity principle.
  • Secondly, papers and documents delivered directly or via the diplomatic channel between competent Vietnamese and foreign agencies. 
  • Thirdly, papers and documents exempted from consular certification and legalization under Vietnamese laws. 
  • Fourthly, papers and documents not required for consular certification and legalization by receiving Vietnamese or foreign agencies under relevant Vietnamese or foreign laws.
