In Vietnam:

  • Consular Department of the Ministry of Foreign Affairs of Vietnam.

  • Other agencies authorized to perform the consular function of Vietnam in foreign countries that have the authority to certify and legalize overseas consular papers.

  • Completing procedures for importing goods from abroad into Vietnam.
  • Foreigners applying to adopt children in Vietnam.

Consular legalization fee: a kind of state fee that the Government has set. The cost of consular legalization calculated from the preparation of the dossiers until receiving the result, including fees for translation, notarization, copies, consular legalization fees, transportation fees, etc.

The fee of consular legalization

  • The fee for consular legalization and certification: 30,000 VND/time. Besides, the fee for issuing copies of papers and documents: 5,000 VND/time.
  • Fees for consular legalization and certification are collected in Vietnam Dong (VND).
  • This cost collected by the competent authority of Vietnam. On the other hand, in order to use such papers and documents in Vietnam or abroad, you must pay an additional cost of consular legalization at the diplomatic mission of that country.
  • Papers without fees for consular legalization:
  1. Directly serving the activities of agencies of the Party, National Assembly, Government, and ministries as well as ministerial-level agencies;
  2. Exemption from the collection of consular legalization fees under international treaties which the Socialist Republic of Vietnam has signed, acceded to, or agreed to. If there are other regulations, then such regulations shall be complied with.
  3. Exempted from the collection of fees for consular legalization and certification of foreign organizations and individuals on the basis of diplomatic relations and other external cases under specific decisions of the Ministry of Foreign Affairs.

Regulations on management and use of consular legalization fee

The fee-collecting organization shall submit the entire collected fee amount into the state budget according to the current State Budget Index. The source of expenses for the collection of fees shall be arranged by the state budget in the estimate of the collecting organization according to the regime and norms of the state budget in accordance with the provisions of law.

In case the fee-collecting organization allowed to set operating expenses according to the regulations of the Government or the Prime Minister on the mechanism of autonomy and self-responsibility in the use of payroll and the use of administrative management funds for State agencies:

  • For dossiers of application for consular certification and legalization submitted at the Ministry of Foreign Affairs; The organization that collects the consular certification and legalization fee (the Ministry of Foreign Affairs) can have 30% (thirty percent) of the fee amount collected before submitting the fee into the state budget. This organization may use it to cover the cost of fee-collection work at the Ministry of Foreign Affairs.
  • For the application for consular certification and legalization submitted at the foreign affairs offices of the provinces and centrally-run cities; the fee-collecting organization (the Ministry of Foreign Affairs) can have 20% (twenty percent), then transfer to foreign affairs agencies of provinces and centrally-run cities another 10% (ten percent) of the fee collected before submitting the fee into the state budget. The organizations may use that money to cover the cost of fee-collection work at the Ministry of Foreign Affairs.
  • Lastly, the remaining 70% (seventy percent) of the fee collected for consular certification and legalization shall be submitted into the state budget according to the current State Budget Index.

The processing time of consular legalization procedure

According to Clauses 5 and 6 of Article 11, Clause 4 of Article 14, and Clause 4 of Article 15 of Decree 111/2011/ND-CP, the processing time for a request for consular legalization:

  • 01 working day from the date of receipt of complete and valid documents, or
  • No more than 05 working days if the application has 10 or more papers and documents;
  • It may take longer if the competent agency needs to check the authenticity of the seal, signature, and title on the papers as well as documents requested for consular legalization.

Thus, how long it takes for consular legalization depends on the quantity and nature of the documents. However, this time usually takes less than 1 working week.
